Can You Get Arrested for a Traffic Violation?

Traffic violations, generally speaking, are not arrestable offenses.  However, there are some traffic offenses that are criminal, and those you can be arrested for.


For example, you can be arrested for reckless driving because it is a crime even though the crime is found in the Vehicle and Traffic Law (VTL) and not the Penal Law it is nevertheless a crime and you can be arrested for it and do jail time for it.

Of course, driving while intoxicated is a “vehicle and traffic” offense, but of course it is a crime that can be either a misdemeanor or a felony that you can be arrested for and possibly do significant jail time.

However, offenses such as speeding, failing to wear a seat belt, failing to maintain a lane by themselves are moving violations and you’ll receive a summons to appear in traffic court.
